OFFICIAL CONTEST RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THE PROMOTION. Purchasing any Freedom Boat Club or Brunswick Corporation products or services, or the products or services of their respective affiliates, will not increase your chance of winning the Promotion.

ELIGIBILITY:

To enter the "Content Submission Contest" (the “Promotion”), you must be, at the time of entering, 21 years of age or older. Promotion is void where otherwise prohibited by law. Employees of Freedom Boat Club, LLC or Brunswick Corporation ("Sponsor") and their affiliated companies, parents, subsidiaries, service partners, and advertising and promotion agencies (collectively, "Promotion Entities"), and their IRS dependents, immediate families (i.e. parents, children, siblings, spouse) and members of their households (whether related or not) are ineligible to participate in this Promotion.

HOW TO ENTER:

NO PURCHASE IS NECESSARY. To enter, visit the Freedom Social Club Facebook Group and once an initial request for submissions has been posted (the “Request”), post a photo or video in reply and responsive to the nature of the Request with the hashtag #FreedomSocialContest (the “Hashtag”). Any posts using the Hashtag will be automatically entered in this Promotion. Only one entry per person is allowed. Multiple entries will be disqualified. All entries must be completed before the time period indicated in the Request (the “Entry Period”). Entries cannot be mailed or emailed and will not be accepted. Inappropriate, incomplete or inaccurate entries will be disqualified from winning.

WINNER SELECTION & NOTIFICATION:

From all entries received, Sponsor will, at its sole discretion, select one winner to receive the Prize (as described below) at the time specified in the Request. The odds of winning depends on the number of entries received.

The selected winner will be chosen solely by Sponsor, and the results will be final. If a Canadian entrant is selected as a possible winner, the Canadian entrant will be required to complete skill component consisting of a third-part mathematical question.

The Sponsor' decisions are based on its sole discretion and interpretation of these official rules and are final and binding in all respects. The selected winner will be notified by Facebook message.

If a selected winner fails to respond to Sponsor’ prize notification or the winner is unable to use or is otherwise ineligible to receive the Prize, that winner will be disqualified and, at Sponsor’ discretion, an alternate winner may be selected.

SWEEPSTAKES PRIZE:

One or more eligible entrant will win a prize as specified in the Request (the “Prize”) with a value which shall not exceed $500. Any specific terms or conditions related to the Prize will be publicized in the Request. The approximate retail value (“ARV”) of any Prize will be less than $500 USD. The Prize Winner may not elect to receive a cash award in lieu of the Prize.

Sponsor reserves the right to make equivalent prize substitutions at its sole discretion. No refunds, compensation or alternatives will be offered to the winner, except at the sole discretion of Sponsor.

Any and all fees and costs and all applicable federal, state, and local taxes and expenses related to acceptance and use of the Prize not specifically stated herein, including but not limited to, fees, taxes, duties, service charges or shipping fees, gratuities, and/or other expenses, are solely the responsibility of the Prize winner. All Prize details are at Sponsor' sole discretion. Sponsor is required by law to report the Prize where required.

In the event winner and/or guest engages in behavior which (as determined by Sponsor in its sole discretion) is obnoxious, threatening or illegal, or which is intended to threaten or harass any other person, or which in any way disparages or adversely affects the reputation, image, and/or customer goodwill of Sponsor, or the Promotion Entities, or any third party that provides products or services in connection with the Promotion or the Prize, Sponsor reserves the right to terminate the Promotion and delivery of the Prize early, and Sponsor (and the Promotion Entities) shall have no further obligations whatsoever (including any obligation to pay compensation) to the winner in respect to the Prize.

TO THE EXTENT PERMITTED BY LAW, SPONSOR AND THE PROMOTION ENTITIES SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, LEGAL IMPLICATIONS OR OTHER DAMAGES OR EXPENSES RESULTING FROM OR ARISING OUT OF THE PRIZE OR ANY ASPECT OF WINNER'S ACCEPTANCE OR USE OF THE PRIZE.

PANDEMIC (COVID-19 Travel Restrictions). If the Prize cannot be awarded due to cancellations or interruptions caused by the COVID-19 pandemic, Sponsor reserves the right to award the Prize in the form of another prize of equal or greater value.

CONDITIONS:

Under certain circumstances, Winner may be required to complete and return certain legal documents in order to claim their Prize. If such documents are not returned within the specified time period, prize or prize notification is returned as undeliverable, Sponsor is unable to contact potential winner or potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor’ discretion, an alternate winner may be selected.

Entrants of the Promotion acknowledge and understand that the Promotion is in no way sponsored, endorsed or administered by, or associated with, any third party that provides products or services to Sponsor.

All federal, state or other tax liabilities (including income taxes) arising from this Promotion will be the sole responsibility of the winner. Except as expressly stated in these Rules, the Prize is not transferable; no prize substitutions are allowed except by the Sponsor who reserves the right to substitute prizes with prizes of equal or greater value. The Prize or any portion of the Prize cannot be redeemed for cash. The Sponsor, its affiliates and agencies are responsible for Prize delivery only. SPONSOR DOES NOT MAKE ANY REPRESENTATION OR WARRANTY WITH RESPECT TO THE PRIZE, AND HEREBY DISCLAIMS ANY AND ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE PRIZE.

WAIVER:

Sponsor and Promotion Entities are not responsible for any technical, mechanical, printing, typographical, human or other error of any kind relating to or in connection with the Promotion, including, without limitation, errors which may occur in the administration of the Promotion, the processing of entries, the announcement of the prize or delivery of the Prize. Sponsor reserves the right in its sole discretion, to disqualify any entrant or entry that is in violation of the Official Rules or to cancel, suspend or modify the Promotion, and disqualify any implicated entrant(s), (and their entries) if any fraud, actions by entrants, technical or other error or problem of any kind, or any other occurrence corrupts or affects the administration, integrity, security, or proper play of the Promotion, as determined by Sponsor in its sole discretion. In the event of cancellation, Sponsor reserves the right, at its sole discretion, to award the Prize in a random drawing from among all eligible, non-suspect entries received up to the time of the event or action warranting such cancellation or to take any other action it deems equitable to fairly award any prize.

NO LIABILITY:

By entering, entrants and the winners agree to comply with all Official Rules as stated and agree to release, discharge, indemnify and hold harmless the Promotion Entities, Facebook, Twitter and Instagram, and each of their respective officers, directors, employees, representatives and agents from and against any claims made by the winner, entrants, or any other third parties, related in any way to the operation of this Promotion as well as any other claims, damages or liability resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Promotion-related activity or participation in this Promotion.

PUBLICITY GRANT:

Except where prohibited by law, winner grants to Sponsor and the Promotion Entities, Sponsor' parent company and any subsidiary thereof, and Sponsor' affiliates, retailers, distributors, advertising and promotion agencies, suppliers, and those acting pursuant to its authority, the right and permission to print, publish, broadcast, and use, worldwide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, the winner's name, portrait, picture, city/town of residence, voice, likeness, opinions and biographical information for advertising, trade, and promotional purposes (including the announcement of his or her name on television or radio broadcast) without additional consideration, compensation, permission, or notification.

ARBITRATION:

Except where prohibited by law, as a condition of participating in this Sweepstakes, entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at a AAA regional office in Sarasota, Florida; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages including attorney’s fees or any other damages, other than for entrant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and entrant further waives all rights to have damages multiplied or increased.
